Section 12B of the Income Tax Act allows investors to convert a portion of their annual tax bill into a qualifying renewable-energy investment. Instead of paying that tax to SARS, capital is redirected into approved solar and energy infrastructure, unlocking significant upfront tax deductions while still participating in long-term income and capital growth.
The impact of this structure is illustrated clearly in the accompanying chart. On a taxable income of R2 million, a typical Section 12B investment offering a 125% deduction materially reduces taxable income. The result is a meaningful reduction in tax expense, often by around 50%, and a corresponding increase in net income. In practical terms, the same earnings generate substantially more after-tax income simply through structuring, not by taking on additional market risk.
There are a number of Section 12B solutions available, each designed to achieve this outcome in slightly different ways. Some focus on maximising the upfront deduction, others on predictable income streams, and others on longer-term infrastructure exposure. While the structures differ, the principle remains the same: using legislation to improve after-tax outcomes by turning tax into an investment rather than an expense.
